SCHENECTADY COUNTY, N.Y. (WNYT) – A state appeals court said a Schenectady County man can pursue resentencing on an older drug case despite later murder convictions.
According to a June 11 court decision from the Appellate Division, Third Department, the court reversed a Schenectady County judge’s order that had denied Rashad H. Scott’s request for resentencing under the Drug Law Reform Act of 2009.
Scott was convicted in 1998 of drug crimes including 3rd degree criminal possession of a controlled substance and 3rd degree criminal sale of a controlled substance. The decision said he was sentenced that October to concurrent prison terms of 7 to 21 years on those felony drug convictions…
