Nobody would want their parents to go through what 64-year-old Felipe Dip allegedly suffered. His two sons have filed a lawsuit against Chestnut Park, a senior living community at Cleveland Circle in Boston, Massachusetts . They alleged extreme negligence by the assisted living home authorities in conducting proper welfare checks. The lawsuit, filed on Tuesday, June 16, in Suffolk Superior Court, alleged that Dip’s dead body went unnoticed for 9 days and was found decomposing, per CBS News.

Dip’s sons, Ricardo Dip Calimano and Benjamin Dip Gerber, have sued the owner, Benchmark Senior Living, and an employee referred to as “John Doe,” who was personally in charge of the victim’s care. As per the lawsuit, Doe was “specifically assigned the responsibility of monitoring Felipe Dip and conducting regular welfare checks to ensure his safety and well-being.” However, Dip was found to be missing meals.
The lawsuit alleged that the staff of the facility should have known when the victim missed almost 27 meals during those nine days. Rules of the facility allegedly have a provision to perform checks whenever a resident misses meals.
Motion-sensing cameras detected “no motion” for nine days.
The lawsuit alleged that Dip’s room was equipped with motion-sensing cameras that registered the last movement on July 12, 2023. However, the staff discovered the victim’s body on July 21, nine days after he was last attended.
“The combination of Felipe Dip’s prolonged and repeated failure to appear for meals and the nine-day absence of any motion in his room provided the defendants with ample and repeated notice that Felipe Dip required immediate attention,” the lawsuit says, per Law&Crime.
The defendants deny claims, saying health and safety “is our top priority”.
Meanwhile, the facility owners have denied the allegations, as the company’s statement read, “The health and safety of our residents is our top priority. Though we cannot comment fully on the merits of active litigation, we strongly disagree with the description of the events and allegations contained in the lawsuit and will defend against them.”…
