BIRMINGHAM, Ala. (WBRC) – A newly-filed Alabama Power contract proposal offers the public a rare glimpse at how Alabama Power plans to serve a controversial data center in Jefferson County, and how difficult it can be to for citizens evaluate the deal.
The public filing redacts nearly every major business term, including the size of the project, how much the customer will pay, the contract length and the financial guarantees backing the deal. Those are the very provisions needed to independently evaluate Alabama Power’s claim that existing customers won’t bear any of the project’s costs. The filing comes as Alabama is overhauling how large data center contracts are reviewed.
The Alabama Public Service Commission (APSC) regulates all large load contracts with Alabama Power, which includes how much large companies pay for power. Alabama Power’s contracts with large data centers also fall under this regulation.
The contract, submitted to the APSC the week of July 30, 2026, is for electric service between Alabama Power and Alabama ADC Holdings, LLC., which Jefferson County property records identify as the owner of the proposed Nebius AI factory site in Birmingham’s Oxmoor Valley.
