The incident, which unfolded on February 8, 2026, has left the community stunned and raised serious questions about hospital protocols. Now, prosecutors have announced that Vincent Lorenzo Fiordilino’s parents will not face charges, despite initial recommendations from police.
According to PEOPLE, the 18-month-old was discovered unresponsive in his family’s pool around 5.30 p.m. First responders immediately began life-saving measures before rushing him to Mercy Gilbert Medical Center, where hospital staff continued resuscitation efforts.
About an hour later, Vincent was pronounced dead. What happened next, however, defies belief. Nearly six hours after being declared deceased, personnel from the Maricopa County Medical Examiner’s Office arrived to retrieve his body and found him breathing inside the hospital’s morgue.
The parents will not be charged
The decision not to charge Vincent’s parents came on July 29, when the Maricopa County Attorney’s Office explained that the case did not meet the standard for prosecution. Officials stated that while police had recommended charges, prosecutors determined there was not a “reasonable likelihood of conviction.”
To secure a conviction, the state would have needed to prove beyond a reasonable doubt that the parents failed to recognize a “substantial and unjustifiable risk” and that their lapse in judgment was a “gross deviation” from what any reasonable person would have done in the same situation…
