NEW YORK CITY (PIX11) – After a brief setback in the courts, Mayor Zohran Mamdani’s pied-à-terre tax rollout can continue, an appeals court judge ordered Thursday.
It’s not quite the end of the road. The pause is only short-lived until the city can plead its case at an appeal hearing. Ultimately, the Mamdani administration will have to fight the lawsuit filed last week, claiming the new tax on second homes was highly stress-inducing for New Yorkers.

The tax rollout began in July and was paused on Monday by a Staten Island judge, who ruled in favor of three homeowners suing to stop the tax’s rollout. They’re represented by former Deputy Mayor Randy Mastro, who is also suing over the Rent Guidelines Board’s rent freeze.
The tax is intended target non-New York City residents who own second homes worth at least $5 million in the city, according to Mamdani. It was approved in the state budget.
