BOCA RATON, Fla. (CBS12) — A Florida law most often associated with deadly shootings is now part of the defense in a viral confrontation involving a 13-year-old, an e-bike and a group of adults inside a gated West Boca Raton community.
Ari David Brooks is asking a Palm Beach County judge to dismiss the felony robbery and misdemeanor battery charges filed against him following the April 3 confrontation inside the Lotus community.
In a motion filed Aug. 6, Brooks argues he never snatched the teenager’s cellphone and only grabbed the child to protect another man involved in the confrontation. His attorney is invoking Florida’s Stand Your Ground law, arguing Brooks’ physical contact with the teenager was legally justified…
