Residents are suing the Perry Township Board of Trustees, Panattoni Development Company and other local agencies, alleging violations of the Ohio Revised Code and the state’s Open Meetings Act.
Developers broke ground on the 100-acre, 240-megawatt data center in Perry Township earlier this year. The lawsuit, filed Tuesday, challenges the amended noise ordinance approved by trustees in October, along with the tax-exemption consent resolution approved by the board in March.
“How Perry Township came to approve these incentives was deficient or defective because they didn’t follow the proper procedures,” Sole Practitioner with Arthur Au LLC Chun Yee Au said. “Those proper procedures and … legal requirements in place are to protect the public’s rights to know, and when those procedures were not followed, it actually undermined the public’s rights to know and transparency of those processes.”…
