Landlord roped into BK flooding suit by Guilderland points finger back at town

GUILDERLAND — The company that owns the land under a Western Avenue Burger King embroiled in multiple lawsuits with the town of Guilderland says it bears no responsibility for a failed stormwater pipe that flooded the property in December 2023, and is now countersuing the town.

VF 1480 Western LLC, which Guilderland named as a third-party defendant in the lawsuit brought against the town in March of last year by Burger King franchisee Carrols LLC, filed its answer on June 8, denying the town’s allegations and placing blame for the flooding squarely back on Guilderland.

The filing now has Guilderland fending off multiple claims on multiple fronts in the same suit: from Carrols, which says the pipe’s failure cost it more than $1.4 million, and from VF 1480 Western, which the town itself brought into the litigation and which says any liability it faces should be Guilderland’s to absorb…
