New Scotland asks judge to declare Hilton Barn contractor in default

NEW SCOTLAND — Six weeks after the town board closed the books on its Hilton Barn construction contract, New Scotland has asked a judge to declare the barn’s contractor in default.

The move is an attempt by the town to ensure it’s not left paying the bill for a worker who claims he fell from a scaffold on the job.

The Aug. 21 motion asks only for a ruling that Sanz, the contractor, defaulted by failing to answer the town’s third-party complaint. Such a judgment would not establish the town’s liability, but could strengthen its effort to make Sanz responsible for defense costs…
