SOUTH GLENS FALLS, N.Y. (NEWS10) — In South Glens Falls, a man who was allegedly breaking into a house was shot by the homeowner. An Albany lawyer discussed whether or not someone can shoot someone who’s invading their home.

According to New York State Police, 20-year-old Hunter Jarvis allegedly invaded a man’s home, who’s name was not released by authorities.
When police arrived, the homeowner and others inside the home were not injured. Jarvis, however, had been shot and was taken to the hospital with non-life threatening injuries.

A legal term adopted by the State of New York called “castle doctrine” says a homeowner can use force on someone breaking in, including deadly force in some instances.
“Generally you can use deadly physical force when you think it’s reasonably necessary,” said Paul DerOhannesian, and attorney with DerOhannesian and DerOhannesian Law Firm. “As long as you have a reasonable fear of serious physical injury, you are allowed to use the deadly physical force.”

Jarvis is charged with second-degree criminal trespass and had to appear in Moreau Town Court on Oct. 14. State police said their investigation is ongoing…
