Family of Schoharie limo victim suing Mavis Tire, claims attorneys sat in on interviews

(WRGB) — A motion has been filed in Albany County Court seeking to disqualify Mavis Discount Tire’s legal counsel due to reported misconduct in a case involving the fatal Schoharie limousine crash. The motion, filed under CPLR 321(B)(2), cites conflicting interests and the need to preserve the integrity of the judicial process.

The motion reports that Mavis’ attorneys participated in interviews with discharged employees, leading to testimony that benefited the company but was known to be false. It claims that the testimony of an employee, Park, was fabricated to convict Nauman Hussain of manslaughter. Hussain was accused of refusing to replace major service brake system repairs as recommended.

The motion further accuses Mavis of providing legal counsel to its employees for false trial testimony after their discharge and using Hussain’s conviction to seek dismissal of plaintiffs’ claims.
