ALBANY — The trailing candidate in the Democratic Party primary for the Common Council’s Third Ward filed a lawsuit Thursday requesting a judge toss out potentially fraudulent ballots and declare him the winner of the June 24 election.
Arthur Lumpkin holds a slim lead over James Davis in the race, a 330-to-326 vote margin, after a July 2 recount, according to results on the Albany County Board of Elections website.
But Davis, in a petition filed by his attorney, claims he has a path to victory. In his petition, Davis says the county Board of Elections has not yet counted the absentee ballot of one voter who was asked to “cure” or fix a deficiency in their ballot and returned it on July 5…
