Albany, NY (WRGB) — 29-year-old Xavier Ortiz from Albany has been sentenced to state prison for gun and drug possession, according to Albany County District Attorney Lee C. Kindlon. Ortiz received a sentence of 4 1/2 years in state prison, followed by five years of post-release supervision. This sentence was handed down by the Honorable William Little after Ortiz pleaded guilty to a three-count indictment.
The charges against Ortiz included Criminal Possession of a Weapon in the Second Degree, Criminal Possession of a Controlled Substance in the Third Degree with Intent to Sell, and Criminal Possession of a Controlled Substance.
The case stemmed from an incident on May 15, 2024, when Albany Police Detectives observed Ortiz engaging in several hand-to-hand drug sales near the corner of Madison Avenue and Grand Street. Upon detaining and searching Ortiz, officers discovered a clear plastic bag containing 15 grams of crack cocaine in his pants.
