On October 29 around 8:30 a.m., officers responded to a fire on the second floor of the Victorian Motel at 752 Columbia Turnpike in East Greenbush. Rensselaer County Fire Investigators determined that the fire was set intentionally, and that the flames had originated from the motel room that Ruth had reportedly been staying in.

Ruth, who was at the scene at the time of the incident, was taken into custody on November 19 as a result of the ensuing investigation and was charged with second-degree arson and two counts of first-degree reckless endangerment. He was released under probationary supervision ahead of further proceedings following his arraignment at Nassau Town Court.
