Court: Prosecutor error no reason to overturn conviction in boy’s freezing death

TROY — A man who punished his girlfriend’s 6-year-old son by locking him outside in freezing temperatures — and then pried his body from the icy porch with a shovel the next morning — won’t be getting a new trial even though prosecutors made a mistake in the case, an appeals court ruled.

Rensselaer County prosecutors should not have shown some photographs of Davonte Paul’s injuries to the jury that convicted Kevin Cox of murder and assault four years ago, the Appellate Division of state Supreme Court ruled on Thursday.

But the five-judge panel ruled the evidence in the case was so overwhelming that displaying the photos was “harmless” and no reason to overturn Cox’s April 2022 conviction…
