Man given conditional discharge after completing court program in robbery case

ALBUQUERQUE, N.M. (KRQE) – The man who admitted to trying to help his friend steal ammo from a Cabela’s will have his case dismissed. Joseph Montoya pled guilty to his role in the 2022 robbery of the Cabela’s near Jefferson St. and Paseo del Norte Blvd.

Montoya was serving as the getaway driver for his friend Gabriel Velasquez who was trying to steal ammo from the store. An off-duty New Mexico State Police officer confronted Velasquez and he responded by opening fire. The officer returned fire hitting Velasquez.

Montoya was sent for treatment in the Young Adults Program last year. He graduated last week. Judge Cindy Leos was impressed with his improvements and gave him a conditional discharge. Velasquez was also given a conditional discharge after successfully completing the Young Adults Program.
