Albuquerque Community Safety workers say the city owes them money in pay dispute

ALBUQUERQUE, N.M. (KRQE) – Workers at the City of Albuquerque’s Community Safety Department said the city owes them money. Six former and five current Albuquerque Community Safety (ACS) employees said the City of Albuquerque improperly categorized them as salaried employees for years, robbing them of overtime and extra holiday pay.

The workers filed a complaint in federal court on Monday, claiming the city violated the Fair Labor Standards Act, which establishes the rules for overtime pay. The Department of Labor spelled out what it means to be an hourly worker, including job duties and salary requirements.

The lawsuit claims the city unfairly took ACS workers out of that category and made them salaried employees. In doing so, the lawsuit claims, the city “Failed to pay the workers overtime at the time and a half rate during the weeks they worked more than 40 hours.”…
