Albuquerque Public Schools settles $3.5M lawsuit with victim injured in classroom sword fight

ALBUQUERQUE, N.M. (KRQE) – A multi-million dollar payout is heading to the family of a former Volcano Vista High student years after that student was severely injured during a sword fight in the middle of a classroom. “Not only did this teacher and APS not protect this child, but actively put her in harm’s way,” that sentiment expressed by Attorney Jessica Hernandez, on behalf of the victim’s family, speaking about a then 16-year-old Albuquerque Public Schools high school student, who was badly injured in a classroom.

It happened in May 2022. According to the lawsuit, a Volcano Vista High School teacher brought two swords into her classroom for a lesson on metal. Attorneys claim that the lesson eventually led to the teacher encouraging students to sword fight, which was caught on camera. “Put deadly weapons right into these students’ hands and exactly what could reasonably be anticipated is what happened,” emphasized Attorney Hernandez.

The victim who sued the district suffered a deep cut in her hand, severing nerves that needed surgical repair. “Job prospects are now off the table for her. She’ll never be able to use her dominant hand the way she used to,” explained Hernandez…
