Albuquerque Uber driver charged with manslaughter wants case to be dismissed on speedy trial complaint

ALBUQUERQUE, N.M. (KRQE) – The case against an Uber driver accused of shooting and killing his passenger has been in limbo for over six years. Now, the driver, Clayton Benedict, is seeking to have his manslaughter charge dismissed.

Benedict has been waiting for his trial for six and a half years, during which he claims the state has delayed the proceedings, violating his constitutional rights.

In 2019, Benedict picked up two men from the Salt Yard Brewery, both of whom were drunk. During the ride, one passenger became ill and threw up in the car. An argument ensued between Benedict and one of the passengers, James Porter, which led to Benedict shooting and killing him. Benedict has claimed self-defense in this incident…
