Tahir T. Sutton will remain free during a dispute over his sentencing in a robbery he committed in 2013, when he was a teenager.
Judge Brian J. Panella granted Sutton’s request be released on his own recognizance, meaning the Phillipsburg man does not have to pay bail, provided he continues to appear at future court sessions and comply with any bail conditions.
His attorney, Elliott Love, has argued Sutton, who pleaded guilty in 2016 in Northampton County for robbing a Wilson gas station and convenience store in March 2013, was never advised his Northampton County sentencing was being served consecutively, and not concurrently, with punishment in New Jersey for another robbery at a service station four days after the Wilson one.
