The legal part is settled. The Fulton County District Attorney’s Office declined to prosecute Darian Morgan, the name on his birth certificate, on a felony aggravated battery charge and a misdemeanor charge of third-degree cruelty to children. Sandy Springs police arrested him on June 20, and he bonded out the same day on $10,000. The charges came from a May 9 dispute at the home he shared with his estranged wife, Alicia Brown. According to the arrest affidavit, the argument started over text messages he had received from a female co-worker, and Brown told investigators he used force to move her and shoved her, causing her to stumble headfirst into an office door and take a cut above her left eye that she said required stitches. Morgan denied all of it from the day it surfaced.
When prosecutors decline a case, the document they file is called a declination. It means the district attorney’s office reviewed what police and the accuser brought them and decided it was not going forward. It is not an acquittal, because there was no trial and no jury. It is not a finding that nothing happened. It is prosecutors saying the case as presented to them is not one they will pursue…
