Texas Court of Criminal Appeals to consider three points of appeal in Marian Fraser case

WACO, Texas (KWTX) – The Texas Court of Criminal Appeals has agreed to consider three of five points of appeal in former Waco daycare owner Marian Fraser’s conviction in the 2013 Benadryl overdose death of an infant in her care.

In what a local criminal appellate specialist describes as a rare move, the state’s highest criminal appellate court this week granted Fraser’s petition for discretionary review in her appeal of a ruling last year by the Amarillo-based intermediate appellate court.
