State regulators have fined Garden Grove-based seafood chain The Kickin’ Crab $120,000, saying the company misled at least 16 California small-business investors by selling them franchises without handing over legally required paperwork on fees, royalties and litigation history. The penalty caps an enforcement matter that also orders the chain to stop the practices regulators flagged and complete remedial training on state franchise law.
According to Daily Bulletin, the California Department of Financial Protection and Innovation determined that Kickin’ Crab failed to register its franchise offerings with the department before selling them, a requirement under the state’s Franchise Investment Law. Per the California Department of Financial Protection and Innovation, that law generally requires franchisors to register with the department before offering or selling franchises in the state, and to hand over disclosure documents and a final franchise agreement at least 14 days before any sale closes. The company was ordered to cease the conduct regulators identified, and the same report notes that the department can revoke Kickin’ Crab’s registration if it fails to comply with the order going forward. A DFPI spokesperson could not provide the names of the 16 franchisees affected, the station’s report adds.
From a Single Santa Ana Storefront to Dozens of Locations
Kickin’ Crab was founded by Jan Nguyen, who serves as the chain’s chief executive officer. Nguyen arrived in the United States from Vietnam at age 11 in 1975 and went on to open the first Kickin’ Crab restaurant in Santa Ana in 2010, according to the Orange County Register. The chain built its menu around Cajun-inspired seafood, including oysters, fish and chips, grilled shrimp, fried fish tacos, and a variety of crab and lobster options, per that same report.
