Former Magnolia Mayor Matthew “Doc” Dantzer is asking a federal judge to dismiss part of a civil lawsuit filed against him by the city secretary who accused him of assaulting her during a work trip to Fort Worth.
In a motion filed last Wednesday, Dantzer’s attorneys argued the claims against him in his official capacity should be thrown out because they are essentially claims against the City of Magnolia itself.
“The claims against Mayor Dantzer in his official capacity must be dismissed for failure to state a claim for relief because they are in effect claims against the City of Magnolia,” attorneys representing Dantzer wrote in the filing…
