Use of Fireworks Can Lead to $1,000 Fine and Six-Month Jail Sentence

Montgomery County Fire and Rescue officials are reminding residents that all fireworks, including sparklers and consumer-grade types, are illegal year-round in the county due to safety risks, and violators may face fines or jail time.

The private use and possession of fireworks, including sparklers, is illegal in Montgomery County and carries a fine of up to $1,000 and/or six months in jail. Public firework displays require proper permits and insurance. According to the U.S. Consumer Product Safety Commission’s 2023 Fireworks Annual Report, fireworks were linked to an estimated 9,700 injuries and eight deaths across the United States in 2023. Approximately 6,400 of those injuries, or 66%, occurred in the weeks around the Fourth of July.

Per Montgomery County Fire and Rescue Services (MCFRS): “As summer celebrations, graduations, and Independence Day approaches, MCFRS Fire Chief Corey Smedley and the Montgomery County Fire and Rescue Service (MCFRS) want to remind residents and visitors that ALL fireworks are illegal year-round in Montgomery County — and with good reason. Fireworks can cause devastating injuries, start fires, and damage property. Not to mention the trauma to animals and pets.
