ASHEVILLE – Buncombe County District Attorney Todd Williams announced Jan. 13 that he found no probable cause to charge a Weaverville police sergeant for shooting a Candler man who pepper sprayed the cop while fleeing a suspected larceny at Walmart.
The announcement came after David Mason Smith, 57, pleaded guilty Jan. 12 in Buncombe County Superior Court to assault on a law enforcement officer, among other crimes. The district attorney’s office said evidence showed Smith was deploying pepper spray at the sergeant’s face when the officer shot him.
