$95K awarded to woman who alleges Denver police set her home on fire during standoff

DENVER ( KDVR ) — Denver City Council approved a $95,000 settlement on Monday night for a woman who has been fighting for funds after police allegedly set her house on fire during a deadly standoff with her son.

Mary Quintana has been fighting for a settlement since 2019, asking the city council in June 2019 for over $1 million and alleging that the Denver Police Department’s tear gas caused the fire inside her home. The fire stemmed from a standoff between police and Mary’s son, where two Denver police officers were injured after the barricaded man reportedly fired at officers.

The man, identified as Joseph Quintana, 35, allegedly barricaded himself inside his mother’s home on North Inca Street after police responded to reports of him firing a weapon in the home. Joseph was transported to a local hospital after the standoff where he was pronounced dead. It appears he died from a self-inflicted gunshot .

During the standoff, Denver police tossed two tear gas grenades into the home: One was a “flameless tear gas grenade” designed for indoor use, but the second was a CN/CS grenade, which the Denver Fire Department reported was “designed specifically for outdoor use due to its fire-producing capability.” The Denver Fire Department’s report on the home fire pointed at the CN/CS grenade as the probable ignition source.
