Settlement reached after lawsuit claims sergeant forced Muslim inmate to shave beard against religious beliefs

DENVER (KDVR) — A settlement was reached after a lawsuit claimed that a Colorado Department of Corrections sergeant forced a Muslim man to shave his beard against his religious beliefs.

In January, Killmer Lane, LLP, a Denver-based law firm, said the State of Colorado, Colorado Department of Corrections and the State Office of Risk Management settled for $245,000 after a lawsuit filed by Tajuddin Ashaheed, a former prisoner in the Colorado State Department of Corrections, against Derrick Porcher, a Colorado Department of Corrections sergeant, after he allegedly ordered him to shave his beard.

This comes after Ashaheed was remanded in July 2016 after technical violations of parole. During intake, the lawsuit said Porcher threatened retaliation with punishment and solitary confinement if Ashaheed didn’t shave his beard.

Ashaheed said the beard was for his faith, but Porcher allegedly said it didn’t apply if it wasn’t a full beard, which Ashaheed couldn’t physically grow, according to the lawsuit…
