Texas court ruling clarifies immunity for police and city during chases

A Texas Supreme Court ruling clarifies the immunity granted to Texas Police officers who get into accidents during chases.

The High Court says neither the City of Austin nor one of its officers can be blamed for a wreck that happened in 2018. The officer, Brandon Bender had tried to pull a car over after hearing gunshots. The driver, instead, took off. Bender and another officer gave chase. But during that chase the two squad cars collided and for a few seconds became locked together.

When they broke apart, Bender’s car slammed into a mini-van that was sitting at a stop sign.

Even though the van driver had nothing to do with the chase, and was injured, the Texas Supreme Court said that neither the City of Austin nor Bender could be sued.

The innocent van driver could not collect damages.
