Plaintiff in lawsuit against Austin Police, Soho Lounge dies in car crash; case to continue

AUSTIN (KXAN) — A lawsuit brought by a woman against the Austin Police Department and Soho Lounge will continue after her death, according to a Nov. 11 filing by her attorney.

Nakole Curry filed her lawsuit with the U.S. District Court in Austin on Sept. 3, alleging that, on Dec. 16, 2023, APD officers improperly opened fire at a suspect while she and other bystanders were in the line of fire. A bullet hit her head during the shooting; she survived, but with permanent blindness in her right eye.

Legal counsel for the city of Austin filed its motion to dismiss the case in October. It argued that the lawsuit failed “to state a claim upon which relief can be granted.” The city also denied her claims that the city and APD failed to properly train its officers in the use of force in a crowded area, de-escalation, crowd control and in limitations on the use of deadly force, as KXAN previously reported.
