Man convicted of murder in 2023 fatal shooting after fight at south Austin club

AUSTIN (KXAN) — A man accused of fatally shooting another man after a fight at a south Austin strip club in September 2023 was convicted of murder in December, according to a news release from the Travis County District Attorney’s Office.

Elliott Garcia, 43, was found guilty of murder by a Travis County jury on Dec. 11. He was then sentenced to 30 years in the Texas Department of Criminal Justice (TDCJ), the release said.

KXAN reached out to Garcia’s attorney on Monday for a comment. We will update this story when or if a comment is received.

On Sept. 9, 2023, the Austin Police Department arrested and charged Garcia with murder for fatally shooting Philip Patrick Foley, 40. He was indicted for the crime on Dec. 2, 2023, the release said.

Prior to the shooting, Garcia got into an argument with one of the servers when he was paying his tab at the club then “shoved a female server in the face,” according to KXAN’s previous report. That led to confrontations from staff members and customers. Eventually the staff asked him to leave…
