BAKERSFIELD, Calif. (KGET) — An 18-year-old who crashed a motorcycle — injuring himself and knocking a passenger unconscious — had a blood-alcohol content above the 0.08% legal limit, according to a court filing released Tuesday.
Given he’s three years away from the legal drinking age, Matthew James Smith III would have been violating the law even if his BAC was as low as 0.01%.
He pleaded not guilty Monday to two counts of felony DUI causing injury, and infractions of operating a motorcycle without a proper license, failure to provide insurance and driving with a measurable BAC while under 21. He’s due back in court June 11…
