Denied a drink, he pulled a knife: DA

BAKERSFIELD, Calif. (KGET) — Upon arriving at Martin Luther King Jr. Park in Bakersfield, Daniel Valdez Gutierrez approached someone and demanded a drink.

The other person refused.

Gutierrez then drew a knife and punctured the tires of the person’s vehicle before swinging the knife at the owner and another person who intervened, prosecutors say.

On Tuesday, Gutierrez, 38, was found guilty of two counts of assault with a deadly weapon, felony vandalism and possession of drug paraphernalia, according to a Kern County District Attorney’s Office release. He faces up to 11 years and four months in prison at his sentencing next month.

Prosecutors say Gutierrez threatened to kill the person who denied him a drink the evening of April 26. He swung a knife multiple times at both that person and the one who came to his aid, the release said.

Police found a knife and methamphetamine pipe on Gutierrez, who was identified at the scene as the assailant, according to the release.
