Ex-BPD officer’s felony case dismissed after completing diversion program

BAKERSFIELD, Calif. (KGET) — Prosecutors wanted a former Bakersfield police officer to serve time on charges he beat a man — breaking bones — and vandalized a vehicle.

However, a judge last year allowed Damien Romero to enter a mental health diversion program.

On Thursday, the case against Romero was dismissed following his completion of the program’s requirements. He’d faced felony charges of battery with serious bodily injury and vandalism.

Prosecutor Richard Choi said the District Attorney’s Office opposed Romero’s entry to the program. He said the decision to dismiss was beyond their authority.

Steven Alvarado, Romero’s attorney, emailed the following statement.

“I’m incredibly happy for Mr. Romero regarding the court’s decision to dismiss his case today. Mr. Romero held up his end of the bargain and is grateful to have earned the opportunity to put the matter behind him and move forward with his life.”
