Birmingham walks back on zoning decisions for AI factory’s power infrastructure

Birmingham’s zoning authority is pulling its special approval of new power infrastructure for a new multibillion-dollar AI factory – though now that approval may not be necessary for the project to proceed.

At the city’s Zoning Board of Adjustments meeting on March 26, board members voted on the special exception request for a power substation to be built at 201 Milan Parkway. That’s the site of the Nebius project slated for the Oxmoor Valley community. That request was initially announced as approved during the meeting, with a vote of three in favor, one opposed and one abstention.

But on April 9, city attorney Nicole King clarified in a memo that this determination wasn’t accurate, based on the board’s rules, which require at least four out of five votes to be in favor for approval…
