According to the arrest report obtained by BocaNewsNow.com, the officer activated lights and sirens near the I-95 overpass on West Palmetto Park Road and got the truck to stop in a nearby plaza at 1255 W. Palmetto Park Rd. When the officer approached, he says he immediately smelled alcohol coming from Demoss, who was the truck’s only occupant. Asked why he was driving so fast, Demoss reportedly told the officer, “I just stepped on the gas, man,” and added that his “car got a little turbo.”
Backup officers who arrived a short time later said Demoss had red, glossy eyes and appeared unsteady on his feet. He told police he had been driving from his house to a gas station to get snacks for his daughter and denied drinking that night, though officers reported smelling alcohol on his breath. Demoss agreed to a series of field sobriety exercises — including the walk-and-turn, one-leg stand, finger-to-nose and Romberg balance tests — but cops say he swayed, used his arms for balance, missed touching the tip of his nose, and misjudged the passage of 30 seconds by 12 seconds. An empty red plastic cup that smelled of alcohol was later found on the truck’s front passenger floorboard, according to the report.
Demoss was taken to the Boca Raton Police Department where he refused to provide a breath sample after being read Florida’s implied consent warning. He now faces charges of driving under the influence, refusal to submit to testing, willfully refusing to sign and accept a summons, and dangerous excessive speeding.
