BOYNTON BEACH, Fla. (CBS12) — A Palm Beach County mother alleges that a Boynton Beach pediatric care center brought her medically fragile 22-month-old daughter home after the child had been without sufficient oxygen for an extended period, according to a wrongful death lawsuit filed this week.
The complaint, filed February 3 in Palm Beach County Circuit Court, accuses Superhero Kids PPEC, LLC of failing to monitor the child’s medical needs, recognize her deteriorating condition, contact emergency services, or notify her parents on July 1, 2024. The toddler, identified in court documents as B.L., required a tracheostomy and supplemental oxygen due to complex medical issues stemming from premature birth.
According to the lawsuit, a Superhero Kids transport van picked up B.L. that morning and brought her to the facility. Staff allegedly failed to supervise or monitor her as required, and by the time she was returned home later that day, she had been deprived of adequate oxygen for a prolonged period.
