Report: Union Block Building owner refiles lawsuit against the City of Boise

BOISE, Idaho (CBS2) — The Idaho Statesman first reported that the owner of the Union Block Building in downtown Boise has renewed his legal battle with the city.

The Union Block Building was closed by the city in November 2023 after inspections revealed structural concerns, a crumbling facade, and concerns about excavations under the sidewalk on Idaho St. The building, formerly the home of Moon’s Kitchen and Mai Thai, has been vacant ever since.

A few months after the initial closure, the building’s owner, Kenneth Howell, filed suit against the city for what he claimed was a violation of his due process rights. That lawsuit was dismissed in March after the judge said that city employees closing a building over substantive concerns of structural issues is not a violation of Howell’s due process…
