A development agreement from 2004 is at the heart of a legal dispute between two property owners and the City of Eagle. Last May, William Smith and Antoinette Smith filed a lawsuit against the City of Eagle alleging the city under former Mayor Jason Pierce violated their due process rights by enforcing a development agreement on their property they were not aware of upon purchasing because it wasn’t recorded properly. And, according to the lawsuit, after the couple contested the city’s violation the Eagle City Council approved a new development agreement on their property without notifying them.
