Idaho inmate adds 40 years to his sentence following brutal attack with a rock

BOISE, Idaho (CBS2) — An Idaho man already serving time in prison has just been sentenced to another 40 years following a brutal attack on a fellow inmate.

The Ada County Prosecutor’s Office reports that 34-year-old Daniel J. Gilmartin has been sentenced to 40 years in prison, 20 of which are fixed, for attempting to kill a fellow inmate with a rock. Gilmartin admitted to police that his intent was to kill the victim, and received a sentencing enhancement for infliction of great bodily injury and for committing the crime inside a correctional facility.

“This sentence underscores the seriousness of committing violence while already incarcerated,” said Ada County Prosecutor Jan Bennetts. “No one — whether in our community or inside a correctional facility — should fear for their safety at the hands of another. I want to commend my trial team and thank the Idaho Department of Corrections and the Idaho State Police for their work on this case.”…
