Idaho inmate’s death prompts federal lawsuit against Department of Correction

BOISE, Idaho (CBS2) — The estate of Milo Warnock, a non-violent inmate serving time for a felony DUI, filed a federal lawsuit against the Idaho Department of Correction (IDOC) and several employees, alleging that the agency’s negligence led to Warnock’s death in December 2023.

Warnock, 45, was killed by his cellmate, James Michael Johnson, at the Idaho State Correctional Center. The complaint claims Warnock was placed in a maximum-security cell with a known violent offender despite repeated warnings and that staff failed to respond to apparent risks before the attack.

The lawsuit asserts constitutional violations under the Eighth Amendment and wrongful death under Idaho law. It names IDOC, Warden Randy Valley and other staff, alleging understaffing, inadequate training, dangerous housing practices and a failure to conduct required safety checks…
