A Boston police officer who’s been charged in the deadly shooting of a carjacking suspect in Roxbury has asked a judge to dismiss the case or appoint a special prosecutor.
Officer Nicholas O’Malley’s lawyer, Karen Read attorney David Yannetti, said that District Attorney Kevin Hayden had prevented the officer from getting a fair trial by holding a press conference after O’Malley’s initial arraignment in the killing Stephenson King Jr. following a report of a carjacking on March 11. O’Malley pleaded not guilty then, and again after a grand jury brought a manslaughter charge against him.
“This is a rare case of a district attorney’s office second-guessing the actions of an officer trying to prevent a violent carjacker from hurting someone else,” the motion says, adding that the press conference that Hayden gave after O’Malley was charged prejudiced the officer “and poisoned the jury pool against” him…
