Violent immigration arrest in Massachusetts leads to prison

BOSTON (WWLP) – A Guatemalan national has been sentenced to prison for assaulting multiple federal officers during an immigration arrest in Marlborough.

In a news release by the Department of Justice in Boston, 24-year-old Guido Andres Cuellar Batres had overstayed his non-immigrant visa by more than four years and, as a result, there was an outstanding immigration warrant for his arrest. In May 2025, four federal officers (three Immigration and Customs Enforcement officers and a Drug Enforcement Administration agent) set up surveillance in a parking lot in Marlborough.

Law enforcement observed Cuellar in the front passenger seat of a vehicle that entered the parking lot. They ordered Cuellar to step out of the vehicle however, he refused. Officers broke the rear passenger window to gain entry and removed Cuellar from the vehicle. During this time, the Justice Department states that Cuellar resisted arrest, tried to bite an officer in the leg, bit another officer above his wrist and struck that officer in the head multiple times. As an officer took hold of Cuellar, he head-butted the officer and spat directly into the officer’s eyes and face.

Guido Andres Cuellar Batres pleaded guilty to forcibly assaulting, resisting, opposing, impeding, intimidating, or interfering with federal officers engaged in the performance of official duties. He was sentenced on Thursday to eight months in prison, to be followed by one year of supervised release.
