Defense seeks new trial for Devin Perkins in crash that killed TikTok star Ali Spice

Attorneys for Devin Perkins, who was convicted this week of vehicular homicide in a crash that killed TikTok’s Ali Spice and two others, are asking for a new trial, arguing the judge erred when she allowed testimony about Perkins’ blood test showing low levels of THC, a chemical that indicates marijuana use.

The defense attorneys are also arguing that speeding is not sufficient to prove reckless driving which is a required element for a vehicular homicide conviction, according to the motion filed by defense attorney David Jancha.

Perkins, 24, of New Smyrna Beach, was driving an Infiniti when it collided with a pickup traveling the wrong way on State Road 44 on Dec. 11, 2022. Three passengers in the Infiniti were killed: Alexandra Dulin, 21, who was also known as Ali Spice with almost a million TikTok followers; Kyle Jacob Moser, 25, of Daytona Beach; and Ava Fellerman, 20, of Treasure Island.
