Judge denies Devin Perkins’ request for new trial in crash that killed Ali Spice, 2 others

Circuit Judge Dawn Nichols has denied a motion for a new trial for Devin Perkins , who was convicted of vehicular homicide Monday following a crash that killed three people, including TikTok star Ali Spice.

Perkins, 24, of New Smyrna Beach, was driving an Infiniti when it collided with a pickup traveling the wrong way on State Road 44 on Dec. 11, 2022. Three passengers in the Infiniti were killed: Alexandra Dulin, 21, who was also known as Ali Spice with almost a million TikTok followers; Kyle Jacob Moser, 25, of Daytona Beach; and Ava Fellerman, 20, of Treasure Island.

Perkins was found guilty of three counts of vehicular homicide and one count of reckless driving — serious bodily injury. The jury of four women and two men deliberated for about 20 minutes before returning the verdict.

Nichols in a brief written order Friday denied the defense’s motion for a new trial. She wrote the motion was “denied as legally insufficient.”

Perkins will face a minimum sentence of 30.5 years and up to life in prison, according to state guidelines, although his attorneys can argue for a lower sentence. The week before the trial, Perkins turned down a plea offer from the state that would have limited his prison time to a range of 10 to 20 years.
