Woman could be arrested after fetus was found clogging restaurant toilet in the Financial District

NEW YORK (1010 WINS) — A woman who may have miscarried in a restaurant bathroom in Manhattan last week could be arrested and charged after the fetus was found clogging a toilet by cleaners the following day, the NYPD said Tuesday.

Investigators are working with the Manhattan District Attorney’s Office to determine whether or not the 20-year-old woman will be charged.

“Most likely it would lead to the arrest of concealment of a human corpse, which is a [class] E felony,” Chief of Detectives Joe Kenny told reporters on Tuesday.

The fetus, a male, which weighed about 1.2 pounds, is believed to have been 22 or 23 weeks gestation. It was found just before 10 a.m. by cleaners at Sophie’s Cuban Cuisine, located on Fulton Street near Gold Street in the Financial District, on Sept. 30.

Kenny said that the woman was a customer of the restaurant the day before the fetus was found.

“She leaves the bathroom and employees are alerted that the bathroom is dirty,” he said. “The next day they come in and find that it’s clogged.”
