Suspected drunk driver seen lying on ground after NYC horror crash that left 2 dead, will face criminal charges: cops

The driver who killed two people and badly injured three others after barreling onto an Upper Manhattan sidewalk tested over the legal driving limit for alcohol after the crash and has been criminally charged, police and sources said Saturday.

Elvin Suarez of Morningside Heights was hit with multiple counts of manslaughter, vehicular assault and DWI, cops said.

His breathalyzer test came back .1, a police source said, well above the legal blood alcohol content limit of .08.
