State Police Arrest Dunkirk Man for Weapon Possession, DWI in Irving

A Dunkirk man was arrested on a felony weapon charge and a drunk driving charge after a traffic stop in Erie County early Monday. State Police in Collins pulled over a pickup truck driven by 22-year-old Richard Gardner for traffic infractions on Erie Road in the Town of Brant shortly before 4:00 AM. Troopers say they detected the odor of an alcoholic beverage coming from the driver’s compartment and also saw an AR-15 style rifle in plain view in the vehicle. Gardner allegedly failed field sobriety tests, and the rifle was confiscated because it did not comply with New York’s SAFE Act. Gardner was arraigned in Collins Town Court on charges of 2nd-degree criminal possession of a weapon, DWI, and multiple vehicle and traffic infractions.
