A Silver Creek man who violated his probation by getting arrested earlier this year will spend 10 years in state prison. Chautauqua County District Attorney Jason Schmidt says 35-year-old David Payne was sentenced Tuesday by Judge David Foley for a Class D violent felony count of 2nd-degree assault and a Class C violent felony count of 2nd-degree burglary. Schmidt says the assault conviction was for a June 2023 domestic incident, while the burglary conviction stems from another domestic incident that occurred in July 2023. Payne was given a one-year interim probation sentence in July 2024; however, Schmidt says he violated those terms by getting arrested in Erie County.
