Judge denies motion to dismiss indictment against Tops shooter

BUFFALO, N.Y. (WIVB) — U.S. District Judge Lawrence Vilardo denied a motion to dismiss the indictment of Tops shooter Payton Gendron because the grand jury lacked a fair cross-section of the community.

The grand jury indicted Gendron in July 2022 on 27 counts for a racially motivated mass shooting at the Tops grocery store on Jefferson Avenue in Buffalo.

Gendron fatally shot 10 Black people and injured three others in a mass shooting he broadcast live on the social media platform Twitch. The federal government is pursuing the death penalty…
